Blood Donation Law of the People’s Republic of China


第一條為保證醫(yī)療臨床用血需要和安全,保障獻血者和用血者身體健康,發(fā)揚人道主義精神,促進社會主義物質文明和精神文明建設,制定本法。
Article 1 This Law is enacted with a view to ensuring the requirements and safety of blood for medical and clinical use, safeguarding the physical health of blood donors and blood users, promoting the humanitarian spirit and the building of socialist material civilization and spiritual civilization.

第二條國家實行無償獻血制度。
Article 2 The State practices the system of blood donation without compensation.
國家提倡十八周歲至五十五周歲的健康公民自愿獻血。
The State encourages voluntary blood donation by healthy citizens between ages 18 and 55.


第三條地方各級人民政府領導本行政區(qū)域內的獻血工作,統(tǒng)一規(guī)劃并負責組織、協(xié)調有關部門共同做好獻血工作。
Article 3 Local people’s governments at all levels provide leadership for the blood donation work within their respective administrative areas, work out uniform planning and shall be responsible for the organization and coordination among the departments concerned in their joint efforts for the blood donation work.
第四條縣級以上各級人民政府衛(wèi)生行政部門監(jiān)督管理獻血工作。
Article 4 Departments of public health under local people’s governments at or above the county level shall supervise over and administer the blood donation work.
各級紅十字會依法參與、推動獻血工作。
Red Cross Societies at all levels shall participate in and promote the blood donation work in accordance with law.


第五條各級人民政府采取措施廣泛宣傳獻血的意義,普及獻血的科學知識,開展預防和控制經(jīng)血液途徑傳播的疾病的教育。
Article 5 People’s governments at all levels shall take measures for the extensive publicity of the significance of blood donation and popularization of the scientific knowledge of blood donation and conduct education in the prevention and control or diseases spread via blood.
新聞媒介應當開展獻血的社會公益性宣傳。
News media shall conduct nonprofit publicity about blood donation in society.
第六條國家機關、軍隊、社會團體、企業(yè)事業(yè)組織、居民委員會、村民委員會,應當動員和組織本單位或者本居住區(qū)的適齡公民參加獻血。
Article 6 State organs, armed forces, social groups, enterprises, institutions, neighborhood committees and villagers’ committees shall motivate and organize citizens of their respective units or neighborhoods to take part in blood donation.
現(xiàn)役軍人獻血的動員和組織辦法,由中國人民解放軍衛(wèi)生主管部門制定。
Measures for the motivation and organization for blood donation by active-duty service personnel shall be worked out by the competent department of health of the Chinese People’s Liberation Army.
對獻血者,發(fā)給國務院衛(wèi)生行政部門制作的無償獻血證書,有關單位可以給予適當補貼。
A certificate of blood donation without compensation produced by the department of public health under the State Council shall be issued to blood donors, and the units concerned may give appropriate allowances.


第七條國家鼓勵國家工作人員、現(xiàn)役軍人和高等學校在校學生率先獻血,為樹立社會新風尚作表率。
Article 7 The State encourages state functionaries, active-duty service personnel and students in institutions of higher learning to take the lead in blood donation to set a role model in new social tendency.
第八條血站是采集、提供臨床用血的機構,是不以營利為目的的公益性組織。
Article 8 Blood stations are institutions that collect and provide blood for clinical use and are nonprofit organizations not for the purpose of making profits.
設立血站向公民采集血液,必須經(jīng)國務院衛(wèi)生行政部門或者省、自治區(qū)、直轄市人民政府衛(wèi)生行政部門批準。
?Establishment of blood stations for the collection of blood from citizens shall be subject to the approval of the department of public health under the State Council or the departments of public health under the people’s governments of provinces, autonomous regions and municipal cities directly under the Central Government.
血站應當為獻血者提供各種安全、衛(wèi)生、便利的條件。
?Blood stations should provide safe, hygienic and convenient conditions for the blood donors.
血站的設立條件和管理辦法由國務院衛(wèi)生行政部門制定。
?Qualifications for the establishment of and measures for the management of blood stations shall be worked out by the department of public health under the State Council.


第九條血站對獻血者必須免費進行必要的健康檢查;
Article 9 Blood stations must conduct necessary physical checkup of blood donors free of charge.
身體狀況不符合獻血條件的,血站應當向其說明情況,不得采集血液。
?Blood stations shall explain the situation to those citizens whose health conditions do not conform to the qualifications for blood donation and must not collect blood from them.
獻血者的身體健康條件由國務院衛(wèi)生行政部門規(guī)定。
?Physical health qualifications of blood donors shall be laid down by the department of public health under the State Council.
血站對獻血者每次采集血液量一般為二百毫升,最多不得超過四百毫升,兩次采集間隔期不少于六個月。
The amount of blood collected by a blood station from a blood donor at a time shall generally be 200 milliliters and must not exceed 400 milliliters at most, and the duration between two collections shall not be less than six months.
嚴格禁止血站違反前款規(guī)定對獻血者超量、頻繁采集血液。

第十條血站采集血液必須嚴格遵守有關操作規(guī)程和制度,采血必須由具有采血資格的醫(yī)務人員進行,一次性采血器材用后必須銷毀,確保獻血者的身體健康。
Article 10 Blood stations must strictly abide by relevant operational procedures and rules in blood collection, blood collection must be conducted by medical staff with qualifications for blood collection and disposable blood collection apparatuses must be destroyed after use to ensure the physical health of blood donors.
血站應當根據(jù)國務院衛(wèi)生行政部門制定的標準,保證血液質量。
Blood stations shall, in accordance with the standards formulated by the department of public health under the State Council, guarantee the quality of blood.
血站對采集的血液必須進行檢測;
Blood stations must conduct inspection and testing over the blood collected;
未經(jīng)檢測或者檢測不合格的血液,不得向醫(yī)療機構提供。
blood without undergoing inspection and testing or failing to pass inspection and testing must not be provided to medical institutions.
